Dismissal of Suit Against HOA Director
On May 14, 2015, Darryl W. Pruett of the Weichert Law Firm obtained dismissal of a lawsuit filed against the director of one of the firm’s HOA clients. The order also assessed attorney’s fees against the plaintiff. Plaintiff was seeking declaratory relief regarding, among other things, the gambling statute (Chapter 47, Penal Code) so as to be able to open and run a gambling operation in proximity to the HOA’s neighborhood, which the HOA opposed.
